Welcome to TROK. These Terms of Service ("Terms") govern your access to and use of the TROK website, platform, and services (collectively, the "Service"), provided by TROK ("we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using TROK, you agree to comply with and be legally bound by these Terms and our Privacy Policy.

2. Eligibility

You must be at least 18 years old to use TROK. By using the Service, you represent and warrant that you are of legal age to form a binding contract.

3. User Accounts

Account Creation: You must create an account to use certain features. You are responsible for maintaining the confidentiality of your account credentials.

Email Verification: We require you to verify your email address. Until verified, your account may be restricted.

Account Security: You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use at hello@trok.pro.

4. Creator Responsibilities

If you use TROK to sell Digital Products, Courses, or Booking Services (collectively, "Creator Content"), you acknowledge that TROK provides software infrastructure. You agree that:

• You are solely responsible for the products, courses, booking services, pricing, refund policies, and customer support for what you sell.
• You own or have the necessary licenses, rights, and permissions to sell and distribute your Creator Content.
• Your Creator Content does not violate any laws, regulations, or third-party rights.
• You will provide accurate information regarding your offerings, pricing, and refund policies.

5. Customer Responsibilities

If you purchase Creator Content via TROK, you acknowledge that TROK is software infrastructure facilitating the transaction and is not the merchant or seller of creator offerings unless explicitly stated. Any issues, disputes, or requests for refunds regarding Creator Content must be directed to the respective Creator, subject to their policies and our general Refund Policy.

6. Acceptable Use and Prohibited Activities

You agree not to use the Service to:

• Violate any local, state, national, or international law.
• Infringe upon the intellectual property rights of others.
• Upload, post, or transmit any content that is unlawful, defamatory, harassing, abusive, fraudulent, or obscene.
• Distribute malware, viruses, or any other harmful computer code.
• Engage in any activity that interferes with or disrupts the Service.

7. Payments and Subscriptions

TROK Subscription Billing: TROK offers paid subscription plans. By selecting a paid plan, you agree to pay all applicable fees in advance on a monthly or annual billing cycle. TROK subscription payments are processed through Dodo Payments.

Cancellation: You may cancel your subscription at any time through your dashboard settings. Cancellation will take effect at the end of your current billing cycle.

Creator Sales: Creators may connect their own supported payment providers such as Stripe, PayPal, Razorpay, or other supported providers. Those providers process payments directly for Creator sales. TROK is software infrastructure and is not the payment processor for those creator transactions. You agree to the respective payment provider's terms of service when utilizing them.

8. Intellectual Property

Our Rights: TROK retains all rights, title, and interest in and to the Service, including all software, design, text, and graphics.

User Generated Content: You retain ownership of the content you upload to TROK. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content solely for the purpose of operating and providing the Service.

10. Third-Party Services

Our Service integrates with third-party services, including but not limited to Google Authentication, Dodo Payments, and Resend. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the actions or omissions of third-party services.

11. Account Suspension and Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice, if we believe you have violated these Terms.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Limitation of Liability

IN NO EVENT SHALL TROK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India.

Any disputes arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts located in Patna, Bihar, India.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on the site or via email. Your continued use of the Service constitutes your acceptance of the revised Terms.
